Decoding Groundwater Regulations- for Borewells in Bangalore



    DO YOU NEED PERMISSION TO DIG A BOREWELL?

Yes.

Under the Section 11 of the Karnataka Ground Water (Regulation and Control Of Development And Management) Act, 2011 And Rules, 2012. It is mandatory to apply for permit to dig new borewells.

Under section 12 and 13, it is mandatory to register the existing borewells and drilling agencies with the Karnataka Groundwater Authority.

    WHO SHOULD TAKE PERMISSION OR REGISTER THE BOREWELLS?

All the users who extract and use groundwater in Karnataka come under purview of the law.

    WHY TAKE PERMISSION?

The authority, after consultations with various expert bodies is of the opinion that it is necessary or expedient in the public interest to regulate the extraction or the use or both of Ground Water in any form in any area.

Therefore, the Authority has declared areas “Notified” based on the groundwater availability and extraction in the given region. As per the notification issued by the Karnataka Groundwater Authority and signed by Member secretary, Department of Mines and Geology, all of Bangalore is declared “Notified”. Hence, a permit is required to dig borewells.

Registration of existing borewells and registration of Borewell digging agencies is made mandatory.

Both Urban and Rural Bangalore is Notified

#1 – Must have a Compressor of the drilling rig with minimum capacity of 900/200 PSI.

#2 – Must possess a machinery to drill a bore well of diameter of minimum of 152 mm.

#3 – Must have appointed driller having a minimum qualification of Diploma in Mechanical Engineering with minimum 3 years’ experience in water well drilling in hard rock terrain to undertake, drilling or digging operation and extraction of groundwater.

In BBMP limits

For e.g. If you are digging your borewell water for domestic purposes, you need to pay Rs 50. If it is for commercial use, you need to pay Rs 500.
But, if the borewell is for newly constructed house, then the application fee will be Rs 500.

Write a pay-in slip for the required amount in the name of Chairman, Karnataka Groundwater Authority, and credit it to the Canara Bank account 0788201052332 of Karnataka Ground Water Authority.

The form with copies of the bank challan, Khata certificate and survey number of the property  with latest BWSSB bill and payment receipt should be submitted to

Chief Engineer, Bangalore Water Supply and Sewerage Board, Kaveri Bhavan, Bangalore - 560 009. You can also submit it in your BWSSB sub division office.

If you make bill payment online, keep the required proof with you. The application will be scrutinised by Senior Geologist, District Groundwater office, 13th floor, Visweswaraiah Towers, Bangalore - 560 001. Then the registration certificate will be issued by the BWSSB. 

In BDA limits

For e.g. in Taluks like Anekal, Dodballapur, Hoskote, Devanahalli etc.  The completed forms with supporting documents have to be submitted to the local governmental authority of that region.

The application will be scrutinised by Senior Geologist, District Groundwater office, 13th floor, Visweswaraiah Towers, Bangalore - 560 001. Then the registration certificate will be issued by the same office.

Registration

After your borewell is dug, they have to registered with the BWSSB for BBMP limits. In other districts the  form-4 has to be submitted to district Groundwater Authority’s senior scientist or deputy director. The certificate will be distributed from the same office on Form 5A.

If any such person does not contain the required permission for the Borewell or a non-registered drilling agency approaches you, file a complaint in the below offices:

    WHAT HAPPENS AFTER YOU SUBMIT THE APPLICATION?

The decision regarding grant or refusal of the permit shall be intimated by the Authority to the applicant within a period of sixty days from the date of receipt of the application. 

The decision is subject to the pre-conditions laid out.

    WHAT TO DO AFTER GETTING PERMISSIONS?

     Every industrial/commercial/other user of groundwater is required to install water measuring device (ISI specification) and furnish the information about the total quantity of groundwater extraction every month to the Authority.

     Every Drilling Agency has to furnish information regarding the date, location and number of borewells drilled with depth, casing and yield of each Borewell every month to the concerned Authority at each district.



    WHAT IF SOMEONE DOESN’T ABIDE BY LAW?

Offense
Penalty
Any person/drilling agency, who obstructs the Authority or any other person authorised by it to exercise any powers under this act or


Shall be liable to punishment which may extent to 5000 Rs and/or imprisonment for a term of 6 months or both
Refuses to furnish any such information to the Authority or furnishes false information

Shall be liable to punishment which may extent to 5000 Rs and/or imprisonment for a term of 6 months or both
Any person indulges in drilling or digging well without a permit from the Authority

Shall be liable to punishment which may extent to 5000 Rs and/or imprisonment for a term of 6 months or both
If any person other than a drilling or digging agency who drills or digs well without permit or continues to extract water in notified area without registration and contravenes or fails to comply with any other provisions of this Act
Liable for punishment with fine which may extend to two thousand rupees or imprisonment for a term which may extend to three months or both.
Any person or drilling or digging agency which contravenes or fails to comply with any other provision of this Act or any rule made thereunder or conditions of certificate of registration
Punishable with fine which may extend to ten thousand rupees or imprisonment for a term which may extend to one year

    @ Yashwanth- The charges depend on the type of connection i.e. domestic or non-domestic. There is a flat tariff of Rs 100 for Domestic connections. More details of tariff is on this link

    @ Abraham- As per the Groundwater Act of 1999, the spacing of 500 mtrs should be maintained from the existing public source of drinking water.

    @ Shree- as per the notification on over-exploited blocks, the district of Mangalore is not included yet. Please check more details on this document.

    @ Probal Ray- As per the details in the Act, there is a designated officer either at GP or block level for Rural areas who would acknowledge application and send it to the Senior Geologist at the Groundwater Authority in Bangalore.   7. In Banshankari 5th stage 7th main 1st cross behind mantri alphine site no 248,there is 60x40 dimension site where the owner of the site has started
    3 bore wells in the same site when questioned he mentioned he had permission he also asked us to go and check with association of the layout when checked he has not submitted we had complained to Department of Mines and Geology. They came and penalty was imposed on builder .But the builder has not stopped drilling what sort of complain should i give to take action or can anybody with this dimension drill 3 bore well.kindly take action
